By accessing this website, booking an outpatient (OPD) consultation, making an advance appointment fee payment, or utilizing our services, you expressly agree to be bound by these Terms, our Privacy Policy, Cancellation & Refund Policy, and Service Delivery Policy. The website allows patients to view specialist profiles, check clinic schedules, book OPD time slots, and pay consultation fees securely online.

4 User Eligibility & Information Accuracy

To use this website and book medical services:

• You must be at least 18 years of age or be booking on behalf of a minor/family member as an authorized legal guardian.
• You agree to provide true, accurate, current, and complete personal and medical history information (including full patient name, valid 10-digit mobile number, and accurate health complaints).
• Providing false, misleading, or deceptive information may result in cancellation of your appointment and refusal of services, without refund.

5 Appointment Booking & Clinic Working Hours

All online appointment bookings are subject to the following clinic operating conditions:

• Regular OPD Working Hours: Monday through Saturday from 9:00 AM to 7:00 PM (IST). (Emergency services operate 24 hours daily).
• Slot Scheduling: Appointments can be scheduled up to 14 days in advance. Appointment time slots are approximate indications and prioritize patients based on triage assessment and doctor clinical availability.
• Emergency Surgery Precedence: In the event that a specialist doctor is called for emergency resuscitation, critical trauma surgery, or ICU intervention, scheduled OPD appointments may experience unavoidable delays or require rescheduling. Our staff will notify you immediately.

6 Consultation Pricing & Razorpay Payment Terms

All pricing on this website is transparent and complies with regulatory standards:

• Currency & Taxes: All consultation and add-on procedure fees are stated in Indian National Rupees (INR ₹) and are inclusive of applicable goods & services taxes.
• Doctor Fee Structure: Standard outpatient consultation fees are clearly displayed per doctor during booking (ranging between ₹200 and ₹800 based on specialty and whether you are a new or follow-up patient).
• Payment Gateway: All online payments are handled securely through our verified payment gateway partner, Razorpay. We accept UPI (Google Pay, PhonePe, Paytm, BHIM), major Credit/Debit Cards (Visa, MasterCard, RuPay), Net Banking (all major Indian banks), and verified digital wallets.
• Booking Token Generation: An appointment is confirmed only upon successful authorization of payment by Razorpay and issuance of a unique Booking Reference ID (NVY-XXXXXXXX).
• No Unreasonable Fees: Nivya Hospital does not impose any hidden booking convenience surcharges. The amount shown on the summary card is the final amount charged.

7 Intellectual Property & Website Usage

All content, text, medical articles, graphics, logos, hospital photographs, and layout designs published on this website are the intellectual property of Nivya Respiratory and Multispeciality Hospitals or licensed appropriately. You may not reproduce, copy, distribute, or create derivative works without prior written permission from hospital management.

8 Limitation of Liability

While Nivya Hospital employs rigorous medical protocols and technical systems:

• Website information is provided for general health awareness and does not replace in-person professional clinical evaluation, diagnosis, or treatment.
• To the maximum extent permitted by Indian law, Nivya Hospital's total monetary liability for any claim arising out of online booking services shall be limited strictly to the actual consultation fee amount paid for that specific appointment.
• Nivya Hospital shall not be liable for internet outages, telecom disruptions, payment gateway failures, or delays resulting from force majeure conditions (such as severe natural disasters, grid failure, or pandemic orders).

9 Governing Law & Dispute Jurisdiction

These Terms and Conditions and any disputes or claims arising out of or related to our services or online transactions shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India.
